This document sets out the terms of the contract and usage agreement between Cloud Coden We and the Customer (User, Customer, You)

Eligibility to open an account

By registering or using one of our services, you acknowledge and guarantee that by using any of our services you agree to these terms, so please read them carefully.

At least 18 years of age. Services provided are intended for those aged 18 years and over. Participation in these services for those under 18 years is a violation of the Employment Agreement.

You are responsible for providing us with valid, accurate and up-to-date data at the time of registration, which includes this email, so that we can communicate with you in the event of any problem or abuse.

Account Security

Your connection with Cloud Coden website is encrypted and secure using HTTPS protocol to protect sensitive information sent online, so no one who is not a designated receiver will be able to read it.

Modifying your personal account or some important information may require confirmation of identity via SMS, phone calls, WhatsApp or email.

Upon completing the registration process on Cloud Codin, you will receive a message containing your account password. Keeping your account information confidential and secure is your responsibility first and last, You also bear full responsibility for any activities made through your account. When you discover any unauthorized access to your account or any hack, you must contact Cloud Codin Team. HVPS is not obliged to compensate for any losses resulting from failure to achieve this item.

Transfer to the company

Our technical support team makes every effort to help you transfer your site to us Transportation is provided as a free service to our customers but we do not guarantee the validity or availability of the site's work or the estimated time to complete the transfer, Each hosting company is configured differently and some of them save data and backups customized or incompatible with general standards unavailability of data ", which makes the transfer extremely difficult in the absence of some data.

Transportation service is free for the first time only, and for a maximum of 15 sites free thereafter it is a paid service and at a specific cost

The ultimate responsibility lies with the client to confirm the site's work properly after completion of the transfer and test it to detect any possible errors

Domains

The company provides a control panel for Arabic/English domains embedded with the customer's account on Cloud Codein website through which the customer can fully control his own domains from management and transfer.

We are committed to providing transfer code to any customer requesting to move to another domain registrar at any time. This request must be made via customer area technical support tickets through your registered account.

We do not provide any free domains within any services we offer.

You are entitled to renew the domain during the grace period up to 30 days from the expiration date of the domain.

You will receive alerts to remind you of the expiry date of the range and the remaining period until it expires and invite you to renew the range to avoid losing it.

You acknowledge and agree that when the domain expires it may be made available for general registration by the registered company of the domains.

If the domain is not renewed during the grace period, it is suspended and the visitor may be converted to a virtual page showing that the site is not working and the page may also display some advertisements.

We are committed to protecting your account and its domains against unauthorized changes, in some cases we may need to confirm the identity to complete the transfer or change the owner account of the domain.

Reseller Hosting

The Reseller Customer must ensure that its customers adhere to our Terms of Use.

The Company reserves the right to provide Reseller customers with their backup files if the Reseller account holder refrains from doing so.

Resler customer is committed to providing technical support to its customers, the company provides technical support to only limited sub-customers.

The Company reserves the right to discontinue any hosted sites on Reseller's account and any services it includes in case of outstanding unpaid invoices.

You will receive alerts to remind you of the expiry date of the range and the remaining period until it expires and invite you to renew the range to avoid losing it.

You acknowledge and agree that when the domain expires it may be made available for general registration by the registered company of the domains.

The company reserves the right to discontinue the Reseller account until it declares its responsibility to the customer.

Shared, cloud and managed hosting

We are committed to maintaining and solving any technical problems related to our servers. We do not provide free technical support for the site with software codes, templates, content management systems, additions or any client-specific software except in a limited manner.

The Company reserves the right to discontinue all sites and hosting services for scheduled maintenance and updates to ensure the highest quality of service provided.

We offer unlimited and no additional expenses.

The Company reserves the right to block or discontinue any services proving to be used or to implicate its IP address in any illicit activities such as (SPAM, DDoS attacks).

It is strictly forbidden to use scrapts (IRC, Proxy, SSH, Telnet) or any other scripts that may constitute significant server pressure as a result of their software nature or a code defect. If any software is discovered that drains the server's resources we may ask the customer to remove them and we have the right to delete them without any prior warning and the service or account may be blocked for review.

You agree and know that the resources of hosting services are limited by the limitations of physical technology as well as by the nature of any service that shares resources, the user should be aware that the server technology identifies the resources that your site can use, to name a few (processor, memory size, speed of access, disk space).

Locations and file storage centers are not allowed on shared, cloud and managed hosting plans.

Torrent software is not allowed to run on shared, cloud and managed hosting plans.

We provide specific resources for hosting services, if consumed or skipped these resources the site may be automatically or manually discontinued and you will have to upgrade to a higher hosting plan suited to your site's requirements.

Shared hosting plans select instant operations as follows: small = 30 processes, personal = 50 processes, business = 70 processes, advanced = 100 processes.

VPS

We are committed to maintaining and solving any technical problems related to our servers. We do not provide free technical support to the site with its software codes, templates, content management systems, additions or any client software.

The Company reserves the right to block or discontinue any services proving to be used or to implicate its IP address in any illicit activities such as (SPAM, DDoS attacks).

We offer unlimited and no additional expenses.

The company reserves the right to stop the server for scheduled maintenance and updates to ensure the highest quality of service provided.

Dedicated servers

The company is committed to delivering the new server information within 24:72 hours of confirmation of the payment process.

The Company reserves the right to discontinue any services in the event of late payment and we bear no legal liability for any damages or loss of data resulting therefrom.

We provide advanced solutions to ensure the highest security of your server, but if your server is not managed by us, the responsibility to update its software lies with you alone.

The monthly server subscription period is 30 days (except February) and the customer must renew the server before the end of this period to avoid any downtime or cancellation.

The Company reserves the right to change the server password to perform any security audit requested by the Data Center.

Cloud Coden is not liable for any damages arising from the modification of server settings by the client or other third parties.

If the server is not managed by us, any unauthorized access as a result of the disclosure of the server's information to other parties shall be borne by the client.

If you subscribe to the Server Management Service, we are entitled not to hand over the Client's server data to ensure that it is secured.

We provide technical support via the ticket system and telephone calls. We do not use any quick text messaging services (such as fast phone chat software) to keep sensitive data fully secure.

Although our servers are secured, a hack to your site may occur as a result of the theft of login information or gaps in the software you place on it, and these problems are unavoidable through the server's general security procedures.

We provide free server setup for the first time only, we do not manage your server or update its software after the setup process, so you may need to subscribe to one of the server management plans if you want to take advantage of its features.

We are obliged not to change server prices for the duration of the customer's subscription without prior notice, and any change in prices or specifications is made after alerting the customer, which is rare

The company does not provide external backup service to any site on the server beyond 50 GB free of charge.

Servers that violate the terms of use of the service may be fined by Datacenter.

Server invoices are issued five days before the renewal date (on 25 of each birth month) and must be paid before the end of the month.

Backup

The Company is committed to backup sites within the server periodically (daily, weekly, monthly) as well as weekly external copies on the Company's servers.

We keep back-up copies of the sites for 30 days from the date of expiration of the service subscription and the company has the right to charge fees if the customer wants to get a backup or recover it.

Backup service is offered to shared hosting, cloud and reseller customers free of charge as value added in recognition of our customers and we reserve the right to change or discontinue their details at any time.

The Company is not liable for any loss of data or information, the protection and preservation of data is the responsibility of the Customer first and finally and we do not bear any losses resulting from the loss of part or all of the data of the hosting sites.

Our customers have the right to request backup files for their sites at any time and we are obliged to deliver them without delay in the event that the customer's account is still active and the private service is not cancelled or discontinued.

Backup is not available for services that have been discontinued as a result of violation of the Agreement and Terms of Use.

Invoices and refunds

Most of our services are prorated, meaning that the renewal date is uniform by the end of each month, so you may notice the cost of the service during the order is different from the cost of the periodic renewal because the system calculates the cost of the remaining days until the end of the month only.

Refund is available for the first order and only new accounts are eligible for refund, for example: if you have an account with us and cancel it and open a new account or other additional account with us you will not have the possibility to recover the value of any services purchased.

The Company reserves the right to discontinue any services as a result of the delay in payment of its renewal dues, and we are not liable for any damages or loss of data as a result.

We do not provide a refund within 30 days to subscribe monthly, instead we provide 7 days to experience the service and decide to continue subscribing or not and you can get your money back during it if there is a problem with our service.

Private servers: We do not provide the ability to recover funds when purchasing full servers, refund funds that are not applicable to full servers or monthly services.

You should contact the technical support team if you have any problems with the service provided to you before requesting any cancellation, retrieval and reply within 24 hours.

Domains: Any domains that are booked and registered cannot be cancelled, changed or refunded after activation, and any value of the domains will be deducted from the amount paid in case of a refund request.

The refund amount does not include any administrative fees, costs of technical support services or preparation fees, nor does it include the cost of licenses of all kinds for servers.

Templates, licenses and visitor plans: but not limited to (WHMCS, cPanel,.....) Its value is non-refundable or cancellable.

Shared Hosting and Virtual Servers: The company provides a money back guarantee within 30 days of subscribing to any of the shared hosting plans and virtual servers only if there is a problem with the service provided.

Any refund or cancellation requests must be made via our ticket system.

Accounts prohibited as a result of violation of the Terms of Service are not eligible to recover the value of any services.

Ressler: Ressler is a commercial account for profit so we do not provide the possibility of refunding any services through this account.

Fees may be charged for refunds made through certain means of payment, but not limited to (bank transfers, Western Union), and these fees will be deducted from the value of the refund.

Services: It is an effort so we do not provide money back for any of the services.

Archiving Plans: It is an effort so we do not provide the possibility to recover funds for archiving services.

Prohibited content and activities

It is strictly forbidden to use the Company's services in any locations that are harmful to the Islamic religion in any way.

It is prohibited to post or circulate any content that violates the law of any state or domestic legislation.

It is prohibited to use any software/codes for the purpose of draining the server's resources and damaging the sites hosted on it.

It is prohibited to post any pornographic or adult content as well as any content that infringes intellectual property rights.

It is prohibited to use the company's services for music, film, series, visual and audio chat, or websites that rely on the webcam communication system.

Sites dedicated to discussions of hack activities, phishing and forgery devices, or distribution of software and hack tools are prohibited.

The use of the company's services at sites promoting drugs, weapons and gambling services is prohibited.

The use of the company's services in sites containing hate speech and racism is prohibited.

It is strictly prohibited to use the Company's services in any activities that may cause disruption of service or damage to our servers or any networks and servers of other companies, including but not limited to (DDOS Attacks - or any other malware).

Termination of contract and closure of account

The Company reserves the right to terminate any account found to be involved in any prohibited activities at any time (with/or without) prior notice to the Customer. Depending on the circumstances of the Order, the Company may engage with the Law Enforcement Authorities and cooperate fully with them in any investigation resulting therefrom.

The Company is committed to respecting customers during any communication between them and the employees of the Company, insulting any employees of the Company that may result in blocking your account and we have the right to take any legal action against you.

The Company reserves the right to amend the Terms of Use and Privacy Agreement at any time. You must review this Agreement periodically to learn about the changes.
